Underground Oil Tank Mortgage 2026: Environmental Concerns and Lender Restrictions

Underground heating oil storage tanks are common in Northeast and Midwest homes and create real lender and insurance issues. Here is what MLOs need to know to manage these transactions.

Before natural gas became widely available in residential neighborhoods across the Northeast and Midwest, many homes used underground heating oil storage tanks (USTs) to supply fuel to their furnaces. These tanks were typically 275 to 1,000 gallon steel tanks buried 3-6 feet below grade. As they age, steel tanks corrode and can leak. A leaking UST contaminates soil and potentially groundwater, creating environmental liability and significant lender concern.

How Lenders and Appraisers Approach USTs

An appraiser observing evidence of a buried tank, including a fill pipe, vent pipe, or soft sunken ground near the foundation, is required to note it in the appraisal report. FHA and VA treat a known UST as a minimum property requirement issue: confirmation that the tank has been properly removed or decommissioned is required before the loan can be insured. Conventional lenders apply their own overlays; many require tank documentation even when the appraisal does not flag it as an issue in areas where USTs are prevalent.

Tank Removal vs. In-Place Closure

The preferred resolution for most lenders is tank removal: the tank is pumped out, excavated, removed, and soil samples are taken to confirm there is no contamination. If samples are clean, the lender receives a closure report from a licensed environmental contractor. In-place closure (filling the tank with sand or foam and abandoning it in the ground) is permitted in some states but is less favorably viewed by lenders because it leaves the tank present and does not allow soil testing in the tank's footprint. Lenders typically require soil sampling regardless of the closure method.

When Soil Contamination Is Found

If soil samples show petroleum hydrocarbon contamination above state regulatory limits, the transaction typically cannot proceed until remediation is complete. Remediation can range from excavating and removing contaminated soil (cost-effective for small spills) to long-term pump-and-treat systems for larger plume events. Costs are highly variable: a simple small spill may cost $10,000-$30,000 to remediate; a large plume affecting groundwater can cost $100,000 or more and take years. Environmental indemnification clauses, state UST fund reimbursements (many states have petroleum cleanup funds), and environmental insurance are all tools that can be used to manage this risk.
