Buyers and agents frequently confuse townhomes and condos. From a street-level view they can look identical. But for mortgage underwriting, the classification is based on legal structure, not physical appearance, and it determines which review process the property must go through. Getting this wrong at intake causes delays when the condo review comes back with project eligibility issues.

The Key Legal Distinction

A condominium is a legal form of ownership where the owner holds title to the airspace of the unit and a shared interest in common areas. A townhome is typically a single-family attached dwelling where the owner holds title to the land and the structure, including the exterior walls. A townhome may have an HOA for shared areas but does not involve condo association ownership of common elements in the same legal sense.

How Fannie Mae and Freddie Mac Classify Attached Properties

  • Fannie Mae classifies a property as a condo if it is legally structured as a condominium under state law, regardless of physical appearance
  • If a townhome is recorded as a condo under a condo regime, Fannie Mae treats it as a condo and requires project review
  • Detached condos that look like single-family homes are also subject to condo project review if the legal structure is a condo
  • Freddie Mac follows the same approach; the legal structure controls, not the physical appearance or HOA structure

Practical Implications for MLOs

When a buyer is purchasing an attached property, always pull the title commitment or check the tax records to confirm the legal property type before intake. A legally-structured condo that must go through limited review or full review adds processing time and may be ineligible if the project does not meet agency standards. FHA condos must be on the FHA-approved condo list or go through DELRAP review. VA requires the condo project to be on the VA approved list.
