FHA spot loan approval (technically Single-Unit Approval under HUD Handbook 4000.1) was reinstated in 2019 after a decade-long gap and has become an important tool for financing condos in projects that lack full FHA approval.
Eligibility Requirements for Spot Approval
- ✦The condo project must be legally established as a condominium under state law and meet basic FHA project eligibility requirements
- ✦No more than 10% of units in the project can have FHA-insured mortgages (the 10% concentration limit)
- ✦The project must have at least 50% owner-occupancy rate
- ✦The project cannot be subject to an active investor-ownership restriction that prohibits FHA financing
- ✦No pending special assessments that are material to the project's financial health
- ✦The HOA must not be in litigation that would materially affect the unit's value or the association's financial stability
How the Process Works
Single-Unit Approval is performed by the lender (an FHA-approved mortgagee with DE authority) rather than by HUD. The lender reviews the condo association documents, budget, and legal status. The lender completes the project approval analysis in the file and certifies compliance. HUD does not pre-approve the unit; the lender's certification carries the risk. This process typically adds three to five business days to underwriting.
When Spot Approval Is the Right Path
Spot approval works when the project meets all substantive eligibility requirements but simply lacks HUD project approval on the FHA Condo Approval Database (FHAC). It does not work if the project itself fails eligibility (too many rentals, major litigation, HOA delinquencies). Check the FHAC database first; if the project is already approved, skip spot approval and use standard project approval instead.
