What a Tax Sale Certificate Is

When property taxes go unpaid, many states allow third parties to purchase the tax lien at a tax sale. The purchaser receives a tax sale certificate, which is a lien on the property with the right to collect the delinquent taxes plus interest and eventually, in most states, to foreclose if the lien is not redeemed. Most mortgage lenders will not close on a property with an outstanding unredeemed tax sale certificate.

Redemption Requirements

The original property owner typically has a redemption period -- which varies by state from months to several years -- to pay off the tax sale certificate holder. The redemption amount includes the original lien amount plus accrued interest and fees. For a mortgage transaction to proceed, the certificate typically must be redeemed (paid off) at or before closing, with title insurance confirming the lien is extinguished.

Title Insurance and Timing

Title companies in many states will insure over a redeemed tax lien but not over an active one. The timing from redemption to title policy issuance varies by state and by the title company's internal requirements. Confirm with the title company early in the transaction whether they will insure, and what documentation they need post-redemption.
