  • Estate sale with no probate: property passes from a deceased owner without court supervision; the seller's right to convey is uncertain
  • Disputed deed: a prior conveyance is being challenged as having been obtained by fraud, duress, or lack of capacity

The Court Process

The plaintiff (typically the current owner or prospective buyer with standing) files a complaint in the appropriate court, usually a state court with jurisdiction over real property in the county where the land is located. All parties with a potential claim to the property must be served. If service cannot be made by personal delivery, substituted service or publication notice is available in most states. After the period for responding expires and any adversary claims are adjudicated, the court enters a judgment establishing title in the plaintiff. That judgment is then recorded in the county land records.

Timeline and Impact on the Transaction

A quiet title action takes three months at the fastest in an uncontested case and can run twelve months or more if any party appears to contest the claim. There is no shortcut. The mortgage transaction is on hold for the duration. Once the final judgment is recorded and the title company reviews it, a commitment can usually be issued. MLOs should assess whether the buyer is willing to wait before investing in an appraisal and application on a property with a title defect requiring quiet title.
