Non-Recourse Mortgage 2026: States With Anti-Deficiency Protections and What They Mean

A non-recourse mortgage limits the lender's remedy to foreclosure on the collateral. If the property sells for less than the loan balance, the lender cannot pursue the borrower personally for the deficiency. Most states allow recourse on residential loans by default. A handful of states have anti-deficiency statutes that make certain residential mortgages non-recourse by operation of law.

States With Purchase Money Anti-Deficiency Protection

  • California: purchase money loans on one-to-four unit owner-occupied property are non-recourse under Code of Civil Procedure Section 580b
  • Arizona: one-action rule and anti-deficiency statutes bar deficiency judgments on purchase money mortgages on qualifying residential property
  • Washington: single action rule limits lenders to nonjudicial foreclosure without a deficiency claim
  • North Dakota and Montana: varying anti-deficiency protections apply to purchase money loans on certain property types

Recourse vs. Non-Recourse in Commercial Lending

CMBS loans are almost always structured as non-recourse. But non-recourse is not unconditional. Bad-boy carve-outs trigger personal liability for fraud, misrepresentation, misappropriation of rents, voluntarily filing bankruptcy, or other specified borrower bad acts. A guaranty is attached to virtually every CMBS loan to cover these carve-outs even while the rest of the debt is non-recourse.

Why This Matters for MLO Clients

Borrowers in non-recourse states who are considering default face a different risk calculation than borrowers in recourse states. In California, walking away from a purchase money mortgage on an owner-occupied home carries no personal liability beyond the credit impact. In Texas, the lender can pursue a deficiency judgment within two years of foreclosure. Know your state's law before advising any client on their options.
