Lead Paint Property Mortgage 2026: FHA, VA, and Conventional Requirements for Pre-1978 Homes

Any property built before 1978 may contain lead-based paint under the EPA's Residential Lead-Based Paint Hazard Reduction Act. Sellers and lessors of pre-1978 housing are required to disclose known lead paint hazards to buyers. In mortgage underwriting, lead paint surfaces in deteriorated condition create specific property condition requirements that must be resolved before most government-backed loans can close.

FHA Lead Paint Requirements

HUD Handbook 4000.1 requires FHA appraisers to inspect all interior and exterior surfaces of pre-1978 properties for deteriorated paint (peeling, chipping, flaking, or chalking). Any deteriorated paint identified during the appraisal must be repaired and stabilized before FHA will insure the loan. This applies to all surfaces: interior walls, ceilings, trim, and exterior surfaces. The repair condition is a standard underwriting condition on most pre-1978 FHA loans with visible deteriorated paint.

VA Lead Paint Requirements

VA has parallel requirements for pre-1978 properties. VA appraisers note deteriorated paint as a property condition affecting minimum property requirements. Remediation is required before VA will guarantee the loan. The VA appraisal is not a lead paint test; it is a visual inspection for deterioration. Testing for lead content in the paint itself is a separate step that the borrower or buyer can commission independently.

Conventional and Lead Paint

Conventional lenders (Fannie Mae, Freddie Mac) do not have a specific lead paint inspection requirement beyond the EPA disclosure requirement. However, appraisers note deteriorated paint as a property condition on conventional files as well, and many conventional underwriters require remediation when visible deteriorated paint is present. The federal Renovation, Repair and Painting (RRP) rule requires certified contractors for renovation work on pre-1978 properties.
