Homestead Exemption and Mortgage 2026: What It Does and Does Not Protect

A homestead exemption reduces property taxes on a primary residence. It does not protect against mortgage foreclosure. But in several states it requires a non-titled spouse to sign at closing. Here is what MLOs need to know.

A homestead exemption reduces the assessed value of a primary residence for property tax purposes. A $50,000 exemption on a home assessed at $400,000 means taxes are calculated on $350,000. This is a tax benefit. It is not a shield against mortgage foreclosure, and it does not eliminate the lender's lien. MLOs need to understand what homestead does and does not cover.

Property Tax Impact by State

  • Florida: $25,000 base exemption on assessed value, plus an additional $25,000 on the portion assessed above $50,000 that applies to non-school taxes
  • Texas: $100,000 general homestead exemption effective January 1, 2023, with additional exemptions for seniors and disabled homeowners
  • New York: STAR program provides a partial exemption for primary residences based on income
  • Most states require a one-time application; Florida does not require annual renewal

Bankruptcy Protection

The homestead exemption in bankruptcy law is a separate concept from the property tax exemption. Texas and Florida have unlimited homestead exemptions in bankruptcy for property meeting state acreage definitions. This can protect equity from unsecured creditors during bankruptcy. It does not discharge a mortgage lien. A lender with a recorded mortgage can still foreclose after discharge if the borrower stops paying, even in Texas and Florida.

Spousal Signature Requirements at Closing

In Florida, Texas, and several other homestead states, a non-titled spouse must sign the mortgage at closing even if they are not on the loan or on title. This spousal consent requirement exists because homestead law gives the spouse a protected interest in the primary residence. A mortgage executed without the required spousal signature is unenforceable as a lien on the homestead in these states. Confirm spousal signing requirements with the title company before scheduling any Florida or Texas closing.
