Estate sale properties are homes sold by an executor or administrator on behalf of a deceased owner. These transactions close at conventional, FHA, VA, and USDA lenders but carry documentation requirements that standard purchase transactions do not. Missing estate paperwork is one of the most common causes of delayed closings on these files.

Required Estate Documents

  • Letters testamentary or letters of administration issued by the probate court
  • Certified copy of the death certificate for the deceased owner
  • Copy of the will or probate order authorizing the sale
  • Court order approving the sale if required by state law, which is common in supervised probate administration

Title Vesting and Executor Authority

Title vests in the estate, not in the executor personally. The executor must have clear documented authority to convey the property. If the title was held jointly with right of survivorship, probate may not be required at all. A recorded affidavit of survivorship combined with the death certificate can convey title to the surviving owner automatically. Common Delays and How to Manage Them

Probate can take months in states with court-supervised administration, especially if the will is contested or heirs are unlocatable. Unpaid medical debts, delinquent property taxes, and mechanic's liens filed against the estate often surface during the title search. Outstanding liens must be paid from estate proceeds before title can be conveyed. Build a 30-to-60-day buffer into expected closing timelines on estate sale files.
