Environmental liens are not like tax liens or mechanics liens. They can attach without notice in some states, survive foreclosure, and create title issues that conventional title insurance will not cure.
Types of Environmental Liens
Federal environmental liens arise under CERCLA (the Superfund law) when the EPA incurs cleanup costs on a contaminated site. These liens attach to all real property owned by the liable party in the district. State equivalents (often called state superfund liens or ISRA liens in industrial states like New Jersey) arise when a state agency funds remediation of a site. Petroleum underground storage tank (UST) liens arise when a state environmental fund pays for tank cleanup and records a lien to recover costs.

How to Identify Risk Early
For any property with a commercial history, gas station, dry cleaner, or industrial neighbor, order a Phase I ESA before the purchase contract becomes binding. The EPA's ECHO database and state environmental agency databases allow a property address search to identify known contamination sites and prior enforcement actions. Finding an environmental issue during the title search rather than at origination protects both the lender and the borrower from a wasted transaction.
