Disputing Credit During the Mortgage Process in 2026: What Breaks the Loan and What Does Not

Active credit disputes during underwriting can block an AUS approval. Timing and method matter. Here is what MLOs need to manage when a borrower wants to dispute inaccurate items mid-process.

Disputing a credit item is a legal right, but doing it while a mortgage is in process creates real problems. An active dispute code on a derogatory account can suppress the negative impact on the score, which means the AUS is evaluating a borrower who appears better than they are once the dispute is resolved. Lenders are required to flag these situations.

What Happens When a Dispute Is Active

Fannie Mae requires that if a dispute appears on a derogatory, non-medical tradeline, DU typically issues a refer or requires the file to clear disputes before resubmission. FHA has a similar rule: active disputes on derogatory accounts with a cumulative balance exceeding $1,000 require resolution before approval. The borrower must either pay the debt, accept the derogatory as accurate, or have the dispute formally withdrawn. Active disputes on zero-balance accounts and medical collections are generally excepted from this rule.

Disputes That Are Generally Acceptable

  • Medical collections: NCAP changes removed many medical collections from reports; disputes on remaining medical items typically do not block AUS
  • Zero-balance accounts with disputes: no material impact on AUS findings
  • Disputes on current positive accounts: no impact
  • Disputes on accounts not in a derogatory status: generally pass through without issue

The Right Strategy

Do not initiate new disputes once a borrower enters the mortgage process unless the item is provably inaccurate and you have the supporting documentation ready to close it quickly. If an existing dispute is blocking AUS, have it withdrawn before resubmitting. Run DU or LP before removing the dispute to understand the actual score impact; removing the dispute may drop the score more than expected.
