The SAFE Act established federal minimum standards for mortgage loan originator licensing, administered through the Nationwide Multistate Licensing System (NMLS). Whether you are starting as an individual MLO or launching your own brokerage, the licensing path runs through NMLS. The requirements are not optional and there are no shortcuts.
Pre-Licensing Education
The SAFE Act requires a minimum of 20 hours of pre-licensing education for all new MLO applicants. This covers federal mortgage laws, ethics, nontraditional mortgage products, and elective topics. Many states require additional state-specific hours on top of the 20-hour federal minimum. Some states require 22 to 30 total hours. Check your state regulator through NMLS before enrolling in a course.
Examination, Background Check, and Credit Review
After completing education, you must pass the SAFE Mortgage Loan Originator Test. The exam includes a National Component and, for most states, a State Component. A passing score is typically 75% or higher. All applicants submit to a criminal background check covering at least 7 years and an employment history check covering at least 3 years. A credit check is also required. Felony convictions involving fraud or dishonesty are disqualifying; other issues are evaluated on a case-by-case basis.
Company Sponsorship and Surety Bond
An individual MLO license requires company sponsorship. You must be employed by and sponsored through an NMLS-licensed mortgage company. If you are launching your own brokerage, you must first license the company entity separately, then obtain your individual MLO license under that company. Most states require a surety bond for the company license; bond amounts vary significantly by state and loan volume.
